It cannot be used to appeal a temporary resident visa refusal, including a visitor, student or worker refusal.<\/p>\r\n<h3 dir=\"ltr\" style=\"text-align: left;\">Inadmissibility restrictions under section 64 IRPA<\/h3>\r\n<p dir=\"ltr\" style=\"text-align: left;\">Section 64 of IRPA restricts IAD appeal rights in cases involving findings such as security, human or international rights violations, sanctions, serious criminality and organized criminality.<\/p>\r\n<p dir=\"ltr\" style=\"text-align: left;\">Misrepresentation requires particular care. An appeal under section 63(1) is generally restricted where the refusal is based on misrepresentation, but the legislation contains an exception where the foreign national is the sponsor\u2019s spouse, common-law partner or child.<\/p>\r\n<p dir=\"ltr\" style=\"text-align: left;\">A refusal letter should therefore be reviewed for both the stated reason and the legal provision supporting it. The word \u201crefused\u201d alone does not establish whether an IAD appeal is available.<\/p>\r\n<h2 dir=\"ltr\" style=\"text-align: left;\">The 30-day sponsorship appeal deadline<\/h2>\r\n<p dir=\"ltr\" style=\"text-align: left;\">The IAD must normally receive the Notice of Appeal within 30 days from the date the sponsored family member received IRCC\u2019s refusal letter. The calculation is based on receipt of the decision, not simply the date printed on the letter.<\/p>\r\n<p dir=\"ltr\" style=\"text-align: left;\">To begin the appeal, the sponsor generally submits:<\/p>\r\n<ul dir=\"ltr\" style=\"text-align: left;\">\r\n<li>A completed IAD Notice of Appeal form<\/li>\r\n<li>A copy of the refusal letter sent to the sponsored family member<\/li>\r\n<li>Accurate contact and representative information<\/li>\r\n<li>Any immediately available material that may help identify or resolve the issue<\/li>\r\n<\/ul>\r\n<p dir=\"ltr\" style=\"text-align: left;\">The IRB\u2019s filing instructions state that the appeal documents must be received within the 30-day period. Keeping proof of when the refusal was received and proof that the appeal was submitted can be important.<\/p>\r\n<h3 dir=\"ltr\" style=\"text-align: left;\">What if the 30-day deadline has passed?<\/h3>\r\n<p dir=\"ltr\" style=\"text-align: left;\">A late appeal should not be treated as automatically accepted. It may be necessary to request an extension of time and explain the delay, the steps taken after learning about the refusal and the potential merit of the appeal.<\/p>\r\n<p dir=\"ltr\" style=\"text-align: left;\">Whether an extension should be requested\u2014and what evidence should support it\u2014depends on the facts. The disclosure package must be provided to both the IAD and Minister\u2019s Counsel.
